Waivers & Legal Terms

"Club" means Canada Elite Basketball, a year-round basketball organization fielding club/rep teams in the U9 through U17 age groups.

"Season" means the full program year a Participant is rostered for, including tryouts and evaluations, team selection, practices and skill sessions, strength and conditioning, league play, exhibition games, tournaments and showcases (in and outside the province or country), team meetings and events, photo/video sessions, and all travel to and from any of them.

"Program Activities" means every activity described in the definition of Season, whether it takes place before, during, or after the scheduled competitive calendar.

"Club Parties" means the Club together with its directors, officers, employees, coaches, team managers, volunteers, trainers, medical and first-aid personnel, contractors, agents, insurers, and successors.

"Released Parties" means the Club Parties together with host facilities and their owners/operators, leagues, associations and sanctioning bodies, tournament hosts, officials and referees, opposing clubs and their participants, billet hosts and transportation providers, and the Club's sponsors and partners (including CrediVersity), and each of their affiliates, employees, and agents.

"Participant" means the rostered or trialling player. "Guardian" means the parent or legal guardian who registers the Participant and who has full legal authority to bind the Participant to these terms.

These terms apply from the moment a Participant attends a tryout or any Program Activity and remain in force for the balance of the Season, and for each subsequent Season in which the Participant is registered or rostered, unless the Club publishes an updated agreement, in which case the updated version applies from its posted effective date.

Basketball is a physical contact sport carried out on hard surfaces at speed. Participation involves inherent and unavoidable risks that cannot be eliminated regardless of the care taken. These risks include, without limitation: sprains, strains, fractures, dislocations, dental and facial injuries, concussion and other head, neck or spinal injuries, heat illness and dehydration, cardiac events, permanent disability, paralysis, and death.

Risks also include contact or collision with other participants, officials, equipment, walls, floors, standards or bleachers; slips and falls; defective or unsuitable equipment; conditions of the facility; the negligence of other participants or spectators; overuse and repetitive-strain injury arising from a long competitive season; exposure to communicable illness; and the possibility that medical assistance, first aid, or emergency response may be delayed, unavailable, or inadequate.

Because the Club operates year-round, additional risks arise from travel to away games, tournaments and showcases, including road and air travel, overnight accommodation, and time spent away from the direct supervision of a Guardian.

The Guardian confirms that the Participant is physically fit and medically cleared for strenuous athletic activity throughout the Season, that participation is entirely voluntary, and that the Guardian has read, understood, and freely and expressly accepts and assumes all such risks on behalf of themselves and the Participant, on a continuing basis for every Program Activity.

In consideration of the Participant being permitted to try out for, be rostered by, and participate with the Club, the Guardian, on their own behalf and on behalf of the Participant and their heirs, executors, administrators, and assigns, agrees: (a) to WAIVE ANY AND ALL CLAIMS they have or may in future have against the Released Parties; and (b) to RELEASE AND FOREVER DISCHARGE the Released Parties from any and all liability for any loss, damage, injury, illness, expense, or death however caused, arising out of or in any way connected with any Program Activity during any Season, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE OF THE RELEASED PARTIES, and including any claim relating to the condition of the premises or equipment, team travel, or the conduct of other participants or spectators.

This release does not apply to liability that cannot lawfully be waived, including gross negligence or wilful misconduct where applicable law prohibits its exclusion, and does not limit any right to statutory accident or health benefits.

The Guardian agrees to HOLD HARMLESS AND INDEMNIFY the Released Parties from any claim, demand, action, cost, or expense (including reasonable legal fees) brought by or on behalf of the Participant, or arising from the Participant's or Guardian's acts, omissions, damage to property, or breach of these terms.

Lost, stolen, or damaged personal property is not the responsibility of the Released Parties. Personal belongings are brought to the venue at the owner's sole risk.

The Guardian authorizes Club staff, coaches, first-aid responders, athletic therapists, and emergency medical personnel to provide first aid and to arrange emergency medical treatment, transportation, or hospitalization for the Participant at any Program Activity, at home or on the road, if the Guardian cannot be reached. The Guardian accepts financial responsibility for all such medical, ambulance, and treatment costs not covered by provincial health insurance or private insurance.

The Guardian confirms that all medical conditions, allergies, medications, and prior injuries relevant to participation have been disclosed truthfully, and undertakes to keep that information current with the Club throughout the Season as circumstances change.

Any Participant suspected of sustaining a concussion or head injury will be removed from play immediately and may not return without written clearance from a qualified medical practitioner. Removal decisions are final and are not grounds for a refund.

Beyond the liability insurance the Club carries through its league or sanctioning body, the Released Parties do not provide accident, medical, dental, disability, or travel insurance for Participants. Families are strongly encouraged to maintain their own coverage, including travel medical coverage for out-of-province and international trips.

The Guardian grants the Club and its designated media partners an irrevocable, royalty-free, worldwide licence to photograph, film, record, stream, and reproduce the Participant's image, likeness, voice, name, age group, team, and performance statistics captured at any Program Activity.

This material may be used in any medium for Club and program promotion, public team pages, recruiting and player profiles, highlight archives, game recaps, social media, sponsor and partner communications, alumni features, and historical records, without further notice, approval, compensation, or inspection rights, including after the Participant leaves the Club.

The Club does not publish home addresses, dates of birth, medical information, or guardian contact details on public pages. A Guardian who does not consent to media use must notify the Club in writing; the Club will make reasonable efforts to exclude the Participant from newly produced material but cannot control third-party spectator recordings, league or broadcast footage, or material already published.

Participants, guardians, and spectators must treat officials, staff, volunteers, opponents, and facility personnel with respect at all times, follow all facility and league rules and staff directions, and refrain from abuse, harassment, discrimination, threats, violence, vandalism, alcohol or drug use, and any illegal activity, at practices, games, team travel, accommodation, and online.

Participants and Guardians must also respect team commitments: attendance expectations, punctuality, uniform and equipment care, league and association eligibility rules (including any rules limiting play with other clubs during the Season), and Club communications channels.

The Club may, at its sole discretion and without refund, suspend, remove, or release a Participant from a team or the Club, or exclude any person from Program Activities, for breach of this Code, falsified registration information, age or eligibility misrepresentation, unpaid fees, or conduct that endangers others.

Children remain the responsibility of their guardians outside of scheduled on-court activity. The Club does not provide childcare or supervision of non-participating siblings, and supervision on team travel is limited to scheduled team activities.

Applying or trying out does not guarantee a roster spot. Age groups (U9 through U17) are determined by birth year in line with the Club's governing league and association rules. Falsified age or identity documentation voids registration without refund.

Roster offers are made at the Club's sole discretion, may be time-limited, and become binding once accepted and the first payment is made. Rosters are capped, and the Club may operate more than one team within an age group; placement on a specific team, and any later movement between teams within the Club, is a coaching decision and is final.

Team assignments, playing time, positions, rotations, game format, schedules, practice times, floor allocation, and tournament selection are determined by the Club and its coaches at their sole discretion. No specific amount of playing time, tier placement, exposure, scouting attention, evaluation outcome, scholarship, or future opportunity is promised or guaranteed.

Jersey numbers are allocated by the Club at uniform hand-out and may change to accommodate uniform inventory. Uniforms and issued equipment remain the property of the Club unless the fee schedule states otherwise and must be returned in good condition at the end of the Season.

The Club may change facilities, practice and game times, schedules, coaching assignments, team structures, and the number of teams in an age group during the Season, and may postpone, shorten, or cancel any Program Activity due to weather, facility closure, public health orders, labour disruption, officiating or league decisions, insufficient registration, or other causes beyond its reasonable control (force majeure). Such changes do not create a right to a refund except as set out below.

Season fees are stated in Canadian dollars and are processed by our third-party payment provider. The Club does not receive or store full card numbers. Provider terms and fees also apply to your transaction.

Accepting a roster spot is a commitment to the full Season fee, whether paid in one instalment or on an approved payment plan. Where a payment plan is used, the Guardian authorizes the scheduled charges and remains responsible for the full balance even if the Participant stops attending. Missed or failed payments may result in suspension from Program Activities until the account is current.

Fees cover the Club's fixed season costs — floor time, league and association fees, coaching, officials, uniforms and administration — which are committed in advance. Season fees are therefore non-refundable and non-transferable once a roster spot is accepted, except where required by law or as set out in the two paragraphs below. Tournament, travel, and accommodation costs are billed separately and follow the cancellation terms of the host or provider.

If the Club cancels a team's Season in full before it begins and does not place the Participant on another team, paid fees are refunded less non-recoverable costs already incurred (such as uniforms already produced). If the Season is cancelled part-way through by the Club, a pro-rated credit or refund of the unused portion of the Season fee is issued, again less non-recoverable costs.

Refunds are not issued for injury, illness, travel disruption, missed practices or games, schedule or facility changes, playing time, coaching decisions, suspension or removal for breach of the Code of Conduct, unpaid-fee suspension, or voluntary withdrawal. A Participant who withdraws for a season-ending injury certified in writing by a medical practitioner may apply to the Club for a partial credit toward a future Season, granted at the Club's discretion.

Discount, bursary, and complimentary codes are issued at the Club's discretion, have no cash value, and may be revoked if used in error or without authorization.

Registration data is collected to operate the Club year-round: tryout and eligibility checks, roster and team management, league and tournament registration, uniform ordering, attendance, medical safety, billing, and team communications. It is stored on secured infrastructure with access restricted to authorized Club staff and the Participant's coaching staff.

Personal information is not sold. Limited information is shared with service providers (payment processing, email delivery, hosting) strictly to deliver these functions, with leagues, associations, and tournament hosts where registration requires it, and with medical or emergency personnel where necessary to protect health and safety.

Only a Participant's name, age group, team, position, photo, and public profile details appear on public team and player pages. Guardians may request correction or deletion of a Participant's data by contacting the Club; deletion may end roster and profile visibility. Records needed for accounting, insurance, and league compliance are retained as long as the law requires.

Club emails about a Participant's team, schedule, and account are transactional and continue for as long as the Participant is registered. Marketing-style messages, where sent, include an unsubscribe link.

Sponsors and partners, including CrediVersity, support the Club but do not organize, supervise, coach, officiate, or control any Program Activity and assume no responsibility or liability for it.

Leagues, associations, tournament hosts, and facility operators set and enforce their own rules, waivers, and policies, which apply in addition to these terms. The Club is not responsible for their decisions, scheduling, officiating, or facilities.

Third-party websites, products, offers, and educational resources linked or referenced by the Club are provided as-is by their owners. The Club makes no representation or warranty about them and is not liable for them.

The Club's programs, this website, and all related information are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the maximum extent permitted by law, the total aggregate liability of the Released Parties for any claim arising out of any Program Activity or these terms is limited to the Season fee actually paid for the Participant for the Season in which the claim arose, and the Released Parties are not liable for indirect, incidental, special, consequential, punitive, or economic loss, including loss of opportunity, playing time, exposure, or reputation.

These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, and the courts of Nova Scotia have exclusive jurisdiction over any dispute.

If any provision is found unenforceable, it will be severed or read down to the minimum extent necessary and the remaining provisions remain in full force. These terms constitute the entire agreement regarding participation and supersede any prior representation.

The Guardian confirms they are 18 years of age or older, have the legal authority to sign for the Participant, have had the opportunity to seek independent legal advice, are signing freely and voluntarily, and understand that a typed name submitted through the registration form is a binding electronic signature that applies to the full Season and each Season the Participant remains registered.
